Summary: California Public Contract Code (PCC) ยง 10298 and 10299 authorizes local government agencies and school districts to use California Multiple Award Schedules (CMAS) Agreements to procure goods and services without public bidding. Vendors and manufacturers are required to honor prices no higher than those established via CMAS. This allows for quick and cost-efficient procurement of project equipment.

As part of Measure R - Phase 2, the District will be replacing HVAC equipment in common areas (e.g., offices, libraries, multi-use buildings, etc.) at Bagby, Fammatre, Farnham, Price, and Sartorette. Due to the high demand for HVAC equipment, lead times, and supply chain issues increasing significantly, the District wishes to delegate authority to the Superintendent or designee to award and enter into the CMAS Agreement. By delegating authority to the Superintendent or designee, allows the District to immediately begin procurement of equipment and supplies. The final agreement price is pending the finalization of equipment schedules.

Recommendation: Staff recommends that the Governing Board delegate authority to the Superintendent or designee to award and enter into an agreement with Ascent, Inc. for up to $800,000 for HVAC equipment for the Phase 2 Modernization Projects under the California Multiple Award Schedules pricing and provisions contract.
